This Privacy Policy describes how Brain Dance Designs LLC ("we," "us," or "our") collects, uses, shares, retains, and protects information when you use Sparky Cooks Recipe Sharing ("Sparky Cooks").

Information We Collect

When you use the App, we may collect the following information:

  • Account information: Your name, email address, account membership and role, profile picture, authentication information, preferences, and related account details. Passwords and authentication credentials are managed through Amazon Cognito and Apple or system security features where applicable.
  • Content you provide: Recipes, recipe tags, folders, grocery lists, comments, questions, cooking notes, imported material, photos, photo tags, shared content, and other information you create or upload.
  • Voice notes and dictation: On iPhone and iPad, supported voice notes use on-device Apple speech recognition and Sparky Cooks does not save or upload the raw recording. Apple TV dictation is provided by Apple. Sparky Cooks receives the resulting text. When you finish Cooking Notes, the transcript may be synchronized with your account and may be sent with applicable recipe context to the Cooking Assistant for processing.
  • Usage and technical information: Feature usage, AI usage and allowance records, device and app information, diagnostic information, errors, security events, and similar operational data.
  • Communications and transactions: Support requests, required account or security messages, notification preferences, and subscription or purchase status. Payment providers process payment credentials; Sparky Cooks receives the information needed to determine entitlement and subscription status.

How We Use Your Information

We use your information for the following purposes:

  • Provide, synchronize, secure, support, and improve Sparky Cooks.
  • Authenticate users, manage accounts and subscriptions, deliver sharing and collaboration, and send required service messages.
  • Process requests made through Cooking Assistant features, including generating automatic recipe tags, and enforce applicable usage allowances.
  • Store and search photos and, when you have granted Cooking Assistant permission and your plan includes the feature, analyze newly uploaded photos to generate searchable tags.
  • Detect abuse, diagnose failures, protect accounts, and comply with legal obligations.

Data Sharing and Disclosure

We do not sell personal information. We may disclose information to:

  • Amazon Web Services (AWS): Hosting, authentication, databases, storage, content delivery, logging, and related infrastructure.
  • OpenAI: When you grant Cooking Assistant permission, applicable recipe content, questions, cooking-note transcripts, imported material, and photos may be sent to OpenAI to provide the feature you request, including recipe assistance, automatic recipe tagging, and automatic photo tagging. We do not send your account password to OpenAI.
  • Twilio SendGrid and similar communications providers: Delivery of account, security, sharing, and other service email.
  • Apple: Apple provides platform services such as dictation, speech recognition, notifications, secure storage, and in-app purchases. Apple's handling of information through its services is governed by Apple's policies.
  • Apple and Stripe, when subscriptions are offered through them: Purchase processing, subscription management, entitlement verification, fraud prevention, and customer support. Sparky Cooks does not receive complete payment-card details.
  • Legal and safety disclosures: When reasonably necessary to comply with law, enforce agreements, protect users, or protect the rights and security of Sparky Cooks and others.

We require service providers that receive personal information to provide the same or equivalent protection described in this policy and to process the information only for authorized purposes.

Cooking Assistant Permission

Sparky Cooks includes Cooking Assistant features powered by artificial intelligence. Before Sparky Cooks sends applicable content to OpenAI, we present an in-app disclosure and request your explicit permission. You may choose Not Now. Without permission, core Cooking Assistant features are unavailable, but you can access the limited account and data-management functions made available by the App.

You may withdraw permission in your account or profile settings. Withdrawal applies to future processing and disables affected features; it does not undo processing that occurred while permission was active. If we materially change what is sent or how it is used, we may request permission again.

Data Retention

We retain account and user content while your account is active and as needed to provide the service. Temporary Cooking Notes processing records are ordinarily removed after you accept or discard the result and are configured to expire after approximately 48 hours if left incomplete. Security, operational, transaction, and backup records may remain for a limited period after deletion where reasonably necessary, including for legal, fraud-prevention, security, and recovery purposes.

Data Deletion

You may schedule account deletion from the account or profile area of Sparky Cooks. You may also contact info@braindance.io for assistance. Account owners may need to resolve active account members, subscriptions, or other account-management requirements before deletion can be completed.

Security

We take the security of your personal information seriously and employ industry-standard security measures to protect your data from unauthorized access, disclosure, or destruction. Accounts are secured using Amazon Cognito authentication and encryption through AWS. However, no method of data transmission or storage is completely secure, and we cannot guarantee absolute security.

Children's Privacy

Sparky Cooks is a general-audience recipe and cooking service and is not directed to children under 13. We do not knowingly collect personal information directly from children under 13. If you believe that a child under 13 has provided personal information through Sparky Cooks, please contact us at info@braindance.io so we can review the matter and take appropriate action.

Your Rights

Depending on your location, you may have certain rights regarding your personal data, including the right to access, update, or request deletion of your information. To exercise these rights, please contact us at info@braindance.io.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will notify you of any significant changes by posting the new Privacy Policy on this page and updating the "Last Updated" date at the top of this page.
